Supreme Judicial Council returns power to remove judges

Finally, the Supreme Court Judicial Council regained the power to remove the judges.

On Sunday (October 20), Chief Justice Dr. A 6-judge appellate bench headed by Sayd Refat Ahmed gave this order.

The lawyers said that the Appellate Division has settled the judgment of the Appellate Division with the power to remove the judges and disclosing the 16th Amendment of the Constitution against the Rt of the Appellate Division, which has now returned to the hands of the Supreme Judicial Council.

Earlier, the 16th Amendment to the Constitution was brought to the Parliament to take the power to remove the judges to the Parliament, but the special bench of the High Court declared the 16th Amendment invalid in 2017. The state appealed against the Rac in 2017. Later on July 3 that year the appeal was dismissed by the Appellate Division.

The full review of the Appellate Division was published on August 1, 2017. Later on December 24 of that year, the state filed a petition for the review of the review petition. But after the introductory government came, on August 15, the 5-judge appeal bench headed by Chief Justice Saitra Refat Ahmed was scheduled for today's hearing.

It should be noted that the power related to the removal of judges in the original constitution was in the hands of the National Parliament in 1972. In 1975, this power was removed from the Parliament and given to the President through the Fourth Amendment to the President. Then in 1977, the judicial council gave the power to the judicial council through the fifth amendment of the Constitution. But in 2014, the power to remove the judges through the 16th Amendment was again in the hands of the Parliament.
