A case has been filed for contempt of court against 7 judges including former Chief Justice Said Mahmud Hossain, former Chief Justice Hasan Fatz Siddiqui and former Chief Justice Obatadul Hasan.
On Wednesday (August 28), Supreme Court lawyer Yunus Ali Akand filed the case in the relevant branch of the High Court.
The case has been stated that the accused do not allow any hearing in violation of the Court of Contempt of Law 1926 outside the legal jurisdiction. In the name of contempt of court. Yunus Ali punished Akand, first on September 27, 2020, he issued a contempt of court rule with the Supreme Court's practice suspension and then on September 12, 2020, he was fined with a three-month practice suspension.
Advocate Yunus Ali said, Section 7 of the Contempt of Court Act 1926, if the professional misconduct of the lawyer is proved, the Bar Council Act can suspend the profession if the tribunal is proved, but not by the appeal.
He also said that in the Appellate Division of Article 104, 108 of the Constitution, the Appellate Division shall not be filed against the High Court's Contempt of Court in the Appellate Division as per Article 103 (2) (c) According to Article 103 (2) (c) the Appellate Division of the Constitution, the person can give the order as per the case for the trial of the Constitution, but no direct case is not directly in the Appellate Division. The interim order debates practice, which violates the human rights under Article 11. The Appellate Division undermines the right to appeal against that punishment.
The other four judges of this case are the former judges of the Appellate Division. Iman Ali, Mirza Hossain Hadar, Abu Bakar Siddiqui and Ma. Nuruzzaman Nani.
